Have you been accused of embezzlement?

You may be in a key position in a nonprofit, bank, state agency or private company, possibly having to do with bookkeeping or finance. Whatever your job, it gives you access to the entity’s funds. Now some of those funds have gone missing and you have been accused of embezzlement. Your career is on the line, to say nothing of the problems this accusation is causing in your personal life.

Every individual case of embezzlement is different, but some elements of this white-collar crime are consistent under many circumstances. Understanding the nature of a typical incident is important for preparing a strong defense.

Common embezzlement factors

A study entitled “The 2013 Marquet Report on Embezzlement” targeted 554 cases, each of which involved a loss of funds amounting to more than $100,000. The researchers were able to find patterns in this data. For example, most of the perpetrators were in their early 40s when they began working on their schemes, and most held some sort of financial position. Nonprofits and government agencies were the types of entities most often found to be the victims of embezzlement, but the financial services industry experienced the greatest monetary losses.

How schemes are accomplished

The study also found that, on average, major embezzlement schemes were accomplished over a period of five years. Often it is about trust. If a small business has a treasured bookkeeper who has been with the company for many years, that person might have been taking relatively small amounts of money for a long time before someone, perhaps an outside auditor, finally found errors that led to the discovery of lost funds.

Seeking legal help

When you are facing an accusation of embezzlement, you need an attorney experienced in handling cases involving white collar crime. If you have been unjustly accused, your rights will be defended with vigor and every effort will be made to restore your good name. Whatever your situation, you should reach out for legal assistance without delay.
