Whenever a criminal charge is made, it is often made more serious when there is a gun involved. Whether the original charge is sexual assault, domestic violence, assault or other crime, the punishment can be enhanced if there is a gun or other weapon present during the alleged incident. The same is true for attempted robbery.
A recent report stated that a 20-year-old Lansing man is being accused of three felony charges: two counts of assault with intent to rob and one felony firearm charge. Even though it wasn't a successful robbery, he reportedly is facing a maximum of life in prison.
According to the police, the incident began when two men and a woman exited a convenience store on West Saginaw Street at about 6:40 in the evening. They were allegedly confronted by the 20-year-old who displayed a gun and demanded money. The report is unclear, but apparently the 20-year-old was in the car of the three convenience store patrons, and during a physical altercation, the 20-year-old was forced out of the car but one of the two men suffered a head wound.
The 20-year-old escaped to a car that was waiting nearby. The police arrived quickly and were able to spot the car with the 20-year-old as it fled. The car was stopped at Princeton and Martin Luther King Junior Boulevard, a distance of about one block, and three men fled on foot. A K9 unit was able to help in apprehending the 20-year-old who was arrested without incident.
The 52-year-old Lansing man who was struck in the head during the altercation was treated at a local hospital for minor injuries.
All three of the charges against the 20-year-old are felonies. It was not reported whether or not the young man has a previous criminal record, however even without a record these are serious charges. There are multiple witnesses involved and their stories may or may not be in conflict.
The 20-year-old is of course innocent until proven guilty beyond a reasonable doubt. Perhaps conflicting testimony will create that doubt.
If you have been criminally charged with a crime involving a weapon, it is imperative that you retain an experience defense attorney who can protect your interests and present a solid defense.
