Detroit House Fire

Two men died Monday morning in a Detroit house fire. The fire was located on the 12800 block of Fielding, near I-96 and Evergreen. The Fire crews were on the scene shortly after 6 A.M. Although one man's identity is not known, it has been released that both men suffered from smoke inhalation while the unknown man also suffered from second-degree burns.

At this time, it is unknown how the fire started, which leaves Arson still on the table as a possible cause. Fires are generally deemed to result from natural causes. The Prosecutor in such cases has the burden of proving beyond a reasonable doubt that they are the result of Arson. Arson is a crime involving the intentional setting of a fire, or in the alternative, requires the defendant to commit an act that the perpetrator knows is highly likely to cause a fire. In the event this fire was the result of Arson, because two men died as a result of the fire, this act of Arson could result in a First-Degree Murder charge and ultimately, a First-Degree Murder conviction.

In Michigan, First-Degree Murder can be a premeditated killing, or a homicide committed during the course of another stated felony. Arson is one of the stated felonies. Therefore, Arson resulting in death, as a "felony murder", is punishable by mandatory life in prison without parole.
